Terms of Service

By creating an account, or by using Designhive on behalf of an organisation, you accept these terms. If you are accepting them for an organisation, you confirm you may bind that organisation, and “you” below means that organisation.

“We”, “us” and “Designhive” mean UnboundIQ Solutions - FZCO, trading as Designhive. “The service” means the Designhive platform, its editor, its AI features, its APIs, its integrations and anything we publish for you at a Designhive address or at a domain you connect.

• You need an account to use the service, and the details on it must be accurate.
• You are responsible for everything done through your account, including by people you invite to a project.
• Keep your sign-in details to yourself. Tell us promptly if you believe somebody else has reached your account.
• You must be old enough to enter a contract where you live, and you must not use the service if we have previously suspended you.

Work in Designhive lives in a project. Whoever creates a project controls it and may invite others and set what each of them may do. Members can see and change what their role allows, and we treat an action taken by a member as taken by the project.

Projects are created for you by Designhive unless your account has been given the ability to create them. New projects include a starting credit balance for AI usage, which has no cash value and cannot be withdrawn, transferred or refunded.

Everything you put into Designhive - your words, pictures, files, data, brand, domain names and the sites and documents you make - stays yours. We claim no ownership of it.

You grant us a licence to host, copy, transmit, display and process your content strictly to run the service for you: to store it, to show it to the people you have given access, to publish what you ask us to publish, and to send the parts that are needed to the AI providers described below. The licence lasts as long as you keep the content with us, and ends when you delete it, apart from copies in backups that expire on their own schedule.

You promise that your content does not infringe anybody’s rights and is lawful to publish.

Designhive writes pages, documents, pictures and video using third-party AI models. To do that, the parts of your content needed for the request - your prompt, your brand settings, and any files you attach or tag - are sent to those providers on your instruction.

• Output is generated. It can be wrong, unoriginal, or unsuitable, and two people can receive similar results from similar prompts. Check anything before you publish it.
• You are responsible for what you ask for and what you then publish. Do not use the AI features to make unlawful material, to impersonate a real person, or to produce sexual imagery of anybody - and never of a child.
• As between you and us, output made for you is yours, subject to your provider's terms and to the rights of others in anything you supplied.
• We may set fair limits on how often AI features can be used, to keep the service available to everybody.

You agree not to:

• break the law, or infringe intellectual property, privacy or publicity rights;
• upload malware, or try to breach, probe or overload the service or its hosts;
• reverse engineer the service, or use it to build a competing product;
• resell or sublicense the service except as a member of a project, or share access credentials;
• publish content that is deceptive, harassing, hateful, or sexualises children;
• use automated means to scrape the service beyond the APIs we offer.

We may remove content or suspend access where we reasonably believe this section has been broken.

• Paid features are charged as described in the product at the time you buy them. Prices may change with notice for future purchases.
• AI usage draws down a project's credit balance. When a balance runs out, AI features stop until it is topped up.
• Credits are prepaid, are consumed as you use the service, expire only as stated in the product, and are not exchangeable for cash.
• Card payments are handled by our payment provider; we do not store full card details.
• Except where the law requires otherwise, payments are non-refundable. If we get something wrong, tell us and we will put it right.
• You are responsible for taxes on your purchases other than taxes on our income.

When you publish, your site is served at a Designhive address and, if you connect one, at your own domain. You must hold the rights to any domain you connect, and you remain responsible for what is published from your project - including anything a member publishes.

The service itself - its software, design, templates, prompt library, documentation and brand - belongs to us or our licensors. Templates and prompts we supply are licensed to you to use inside the service to make your own work; they are not yours to extract, republish or resell as a library.

Designhive relies on other companies to host data, deliver email, take payments and run AI models, and it can connect to services you choose, such as Slack. Those services have their own terms, and what happens inside them is between you and them.

Our Privacy Policy explains what personal data we handle and why. Where we process personal data on your behalf as part of the service, our Data Processing Addendum applies and forms part of these terms.

We work to keep the service available, but it is provided as it is. We may change, add or remove features, and we will not remove something you rely on without reasonable notice where we can avoid it. Planned maintenance and occasional downtime are part of running a service.

To the fullest extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, uninterrupted operation, or that AI output will be accurate or suitable. Nothing in these terms excludes rights you have as a consumer that cannot be excluded.

To the fullest extent the law allows, neither party is liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or data. Our total liability arising out of or relating to the service in any twelve-month period is limited to the amounts you paid us for the service in that period.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

You will defend and indemnify us against claims brought by a third party arising from your content, your use of the service in breach of these terms, or anything you publish through it.

• You may stop using the service and delete your account at any time.
• We may suspend or end access if you break these terms, if your payments fail, or if we are required to by law - with notice unless the situation makes notice unreasonable.
• When the agreement ends, your right to use the service stops. Export anything you want to keep first: after a reasonable period we may delete your content.
• Clauses that by their nature should survive - content ownership, liability, indemnity, governing law - survive.

We may update these terms. If a change is material we will give reasonable notice, by email or in the product, before it takes effect. Continuing to use the service after that means you accept the updated terms.

These terms are governed by the laws applicable in the Emirate of Dubai and the federal laws of the United Arab Emirates, and the courts of Dubai have exclusive jurisdiction, except that either party may seek injunctive relief wherever appropriate.
